These terms and conditions outline the agreement between the sterlingtoursandtravelsinc for the use of the payment. By using the Services, the Merchant agrees to abide by these Terms.

Account Setup and Security :
a. The Merchant must create an account with the Provider to use the Services. The Merchant shall provide accurate and complete information during the account setup process. b. The Merchant is responsible for maintaining the confidentiality of their account credentials and ensuring the security of their account. The Merchant agrees to notify the Provider immediately of any unauthorized use of their account.

Payment Processing :
a. The Provider will process payments on behalf of the Merchant for the travel services offered by the Merchant.
b. The Provider may charge transaction fees for each payment processed. The Merchant shall pay these fees as agreed upon with the Provider.
c. The Provider will transfer the funds collected from the payments to the Merchant's designated account, subject to any applicable fees or deductions.

Compliance with Laws and Regulations:
a. The Merchant agrees to comply with all applicable laws, regulations, and industry standards related to the provision of travel services and payment processing.
b. The Merchant is solely responsible for obtaining any necessary licenses, permits, or certifications required to operate their travel agency and use the Services.

Refunds and Chargebacks:
a. The Merchant is responsible for handling customer refund requests and chargebacks related to the travel services offered. The Provider may assist in the process but is not liable for any disputes or losses arising from refunds or chargebacks.
b. The Provider may deduct any refund amounts or chargeback fees from the funds to be transferred to the Merchant's account.

Service Availability and Support:
a. The Provider will make reasonable efforts to ensure the availability and reliability of the Services. However, the Provider does not guarantee uninterrupted or error-free operation of the Services.
b. The Provider will provide support to the Merchant regarding the use of the Services. The Merchant may contact the Provider's support team for assistance.

Data Security and Privacy:
a. The Provider will implement reasonable security measures to protect the Merchant's data and transaction information. However, the Provider cannot guarantee the absolute security of data transmitted or stored using the Services.
b. The Provider will handle personal information in accordance with applicable privacy laws and its privacy policy.

Termination:
a. Either party may terminate the agreement by providing written notice to the other party.
b. The Provider may suspend or terminate the Merchant's access to the Services immediately, without prior notice, if the Merchant breaches these Terms or engages in fraudulent or illegal activities.

Limitation of Liability:
a. The Provider shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of the Services.
b. The Provider's total liability, if any, shall not exceed the total fees paid by the Merchant to the Provider in the six (6) months preceding the event giving rise to the liability.

Amendments :
a. The Provider may modify these Terms from time to time by providing notice to the Merchant. The Merchant's continued use of the Services after receiving such notice constitutes acceptance of the modified Terms.

Governing Law and Jurisdiction:
a. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Provider is located.
b. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the Provider's jurisdiction.
